Terms & Conditions

These general terms and conditions govern access to the www.westaysliving.com website, requests for information and booking, as well as, when a booking is confirmed, the stays offered under the WeStays Living brand.

They apply subject to the specific conditions provided to the client before the confirmation of their booking. These specific conditions specify in particular the residence concerned, the dates of the stay, the price, the services included, the payment terms, the amount of the security deposit and the applicable cancellation conditions.

In these conditions, the terms "WeStays Living", "we", "our" or "us" refer to this company.

2. Purpose

These conditions define the rights and obligations of WeStays Living and of any person using the website, making a booking request or staying in a residence offered under the WeStays Living brand.

They govern in particular the use of the website, the formation of the booking, the payment terms, the conditions of occupancy of the residences, the respective responsibilities of the parties as well as the rules applicable in the event of cancellation or dispute.

3. Definitions

In these conditions:

The "client" refers to any person of legal age making a booking request or entering into a booking with WeStays Living.

The "resident" refers to the client as well as any person authorized to occupy the residence during the stay.

The "residence" refers to the private accommodation as well as, where applicable, the common areas, equipment and services made available to residents.

The "stay" refers to the period between the arrival date and the departure date confirmed in the booking.

The "specific conditions" refer to the proposal, the quote, the contract, the booking confirmation or any other document sent to the client specifying the characteristics specific to their stay.

4. Scope and acceptance

These conditions are accessible at any time on the website.

Consulting the website does not, on its own, result in the conclusion of a stay contract. The booking becomes contractual only under the conditions provided in the article dedicated to booking.

Before confirming their booking, the client acknowledges having read these conditions, the specific conditions applicable to their stay and, where it exists, the residence's internal rules.

In the event of a contradiction between these general conditions and the specific conditions expressly accepted by the client, the specific conditions prevail for the elements specific to the booking concerned.

5. Conditions required to book

Any booking must be made by a person of legal age who has the legal capacity necessary to conclude the contract.

The client warrants the accuracy, sincerity and currency of the information provided to WeStays Living.

When the booking is made for several residents, the client undertakes to provide them with these conditions and the applicable internal rules. They remain the main point of contact for WeStays Living and are responsible for compliance with the contractual obligations by the persons they have registered or authorized to stay in the residence.

WeStays Living may request the information and documents reasonably necessary for the study and management of the booking, in particular an identity document, the residents' contact details and the information necessary for payment.

6. Booking request

The information, photographs, descriptions, indicative prices and availability presented on the website are provided for information purposes. They do not constitute a firm contractual offer until availability and price have been confirmed by WeStays Living.

Any request sent from the website, by email, by phone, by WhatsApp or by any other channel constitutes only a request for availability.

After receiving the request, WeStays Living may send the client a proposal or specific conditions specifying in particular:

  • the residence or the category of accommodation offered;
  • the dates and duration of the stay;
  • the number of authorized residents;
  • the total price and any additional fees;
  • the services included;
  • the payment terms and deadlines;
  • the applicable security deposit;
  • the modification and cancellation conditions;
  • any rule specific to the residence or the stay.

This proposal may be subject to a validity period. Failing acceptance and payment within the indicated time, WeStays Living does not guarantee the maintenance of the availability or the price offered.

7. Booking confirmation

The booking becomes final only after:

  • the acceptance of the specific conditions by the client;
  • the acceptance of these general conditions;
  • receipt of the payment, deposit or requested guarantee;
  • and the sending of a written confirmation by WeStays Living.

An automatic acknowledgment of receipt of a form or a request does not necessarily constitute a booking confirmation.

WeStays Living may refuse a request when the residence is no longer available, when the information provided is incomplete or manifestly inaccurate, when a payment is declined or when there is a legitimate reason related to safety, the capacity of the accommodation or compliance with the residence's rules.

8. Description of the residence

WeStays Living strives to present the residences, their equipment and their services accurately.

The photographs, plans, illustrations, renderings, videos and virtual tours are presented for illustrative purposes. Slight differences may exist in particular with regard to decoration, furniture, layout, view or configuration, without modifying the essential characteristics of the accommodation booked.

When the booking concerns a category of accommodation and not a precisely identified unit, WeStays Living may assign the client an accommodation belonging to that category or having equivalent characteristics.

The dimensions, capacities and essential services applicable to the stay are specified in the specific conditions.

9. Prices

The applicable price is the one indicated in the specific conditions accepted by the client.

Unless otherwise stated, the price may include the occupancy of the accommodation, access to the authorized common areas, the furniture, the equipment made available as well as the services expressly mentioned in the booking confirmation.

The client is informed of the total price known at the time of booking and of any fees whose amount can only be determined according to their use of the services.

Prices are expressed in Israeli shekels, unless otherwise indicated. When the client pays in another currency, conversion fees or differences may be applied by their bank or payment provider. These fees remain their responsibility.

10. Payment terms

The terms, deadlines and accepted means of payment are indicated in the specific conditions.

Depending on the residence and the duration of the stay, WeStays Living may request:

  • full payment at the time of booking;
  • a deposit at the time of booking, then the balance before arrival;
  • monthly or installment payments;
  • a bank pre-authorization;
  • a security deposit.

The client undertakes to pay each sum when due.

In the event of late payment, rejection or non-payment, WeStays Living may request regularization within a determined period. Failing regularization, the booking may be suspended or cancelled under the conditions specified to the client, without prejudice to any sums due under the applicable cancellation policy.

Bank fees, rejection fees or commissions related to the chosen means of payment remain the responsibility of the client when they are attributable to them.

11. Security deposit

A security deposit may be requested to cover in particular damage, losses, unpaid amounts, restoration costs, keys or badges not returned and breaches of the stay obligations.

Its amount, its method of payment and the conditions for its return are indicated in the specific conditions.

The security deposit does not constitute a limit of liability. When the amount of the justified costs exceeds that of the deposit, WeStays Living may request the client to pay the balance.

Subject to the condition of the accommodation, the payment of all sums due and the return of the means of access, the deposit is released or returned within a maximum period of [number of days to be confirmed] after departure.

Any withholding may be justified by photographs, an inventory of fixtures, an invoice, a quote, an intervention report or any other relevant element. Normal wear and tear resulting from proper use of the accommodation cannot be charged as damage.

When a bank pre-authorization is used, the time for the release to appear on the client's account may depend on their bank.

12. Modification of the booking by the client

Any modification request must be sent in writing to WeStays Living.

A modification of dates, duration, residence, type of accommodation or number of residents remains subject to availability, reception capacities and the prices applicable at the time of the request.

WeStays Living is not obliged to accept a modification. When it is accepted, it may result in a modification of the price, administrative fees or the application of the cancellation conditions to the part of the stay removed.

The modification becomes final only after written confirmation from WeStays Living and, where applicable, payment of the additional sums requested.

13. Cancellation by the client

Any cancellation must be sent in writing to WeStays Living.

The cancellation conditions, the deadlines and any sums withheld are communicated to the client before the confirmation of their booking and appear in the specific conditions.

Unless otherwise expressly provided in these specific conditions, cancellation fees are calculated according to the date on which WeStays Living receives the written request.

Services already performed, costs incurred on behalf of the client and any non-refundable fees may remain due within the limits provided by the applicable regulations.

The client's absence on the arrival date, without prior notice and without the written agreement of WeStays Living, may be considered a no-show. The applicable financial consequences are specified in the specific conditions.

14. No right of withdrawal where the law provides for it

When the booking concerns the provision of accommodation on a specific date or during a specific period, the right of withdrawal possibly applicable to certain contracts concluded at a distance may be excluded in accordance with the applicable regulations.

In this case, any cancellation is subject to the cancellation policy communicated before the booking.

When the mandatory regulations applicable to the client provide for a more favorable right which cannot be waived, this right remains applicable.

15. Cancellation or modification by WeStays Living

WeStays Living may have to modify or cancel a booking when its performance becomes impossible or presents a serious risk, in particular in the event of:

  • unforeseen unavailability of the residence;
  • significant damage or urgent works;
  • a safety problem;
  • an administrative or governmental measure;
  • force majeure;
  • non-payment;
  • a false declaration;
  • a serious violation of these conditions or of the internal rules.

When the cancellation is not attributable to the client, WeStays Living strives, depending on the circumstances, to offer a reasonable solution: equivalent accommodation, modification of the dates, credit note or refund of the sums corresponding to the services not provided.

However, no replacement accommodation can be guaranteed when the situation, availability or exceptional circumstances do not allow it.

16. Arrival

The arrival procedures, the times, the address, the access instructions and any required documents are sent to the client before the start of the stay.

The client must respect the agreed time or inform WeStays Living as soon as possible in the event of delay.

An early or late arrival is subject to the prior agreement of WeStays Living and may result in additional fees when they have been communicated to the client.

WeStays Living may request the presentation of an identity document and the signing of an inventory of fixtures, an inventory or the internal rules before handing over the keys, badges or access codes.

17. Departure

The accommodation must be vacated no later than the time indicated in the specific conditions or the stay instructions.

At the time of departure, the resident must in particular:

  • remove their personal belongings;
  • leave the accommodation in a reasonably clean condition;
  • comply with the instructions regarding waste;
  • return the keys, badges and other means of access;
  • report any damage or anomaly observed.

An unauthorized late departure may result in the charging of additional fees and, when the delay prevents the arrival of the next resident, fees corresponding to the actual loss suffered.

18. Occupancy of the residence

The resident undertakes to use the accommodation and the common areas in a peaceful, careful manner and in accordance with their intended purpose.

The number of people occupying the accommodation cannot exceed the capacity indicated in the booking. Any additional person must be previously authorized by WeStays Living.

Unless authorized in writing, it is in particular prohibited:

  • to assign or sublet all or part of the accommodation;
  • to organize a party, a reception or an event;
  • to carry out a commercial activity open to the public;
  • to disturb the tranquility of other residents or of the neighborhood;
  • to bring in dangerous or illicit substances, objects or equipment;
  • to modify, move or dismantle the fixed installations;
  • to disable the safety devices;
  • to use the premises for purposes contrary to the law.

The client is responsible for the behavior of their companions and visitors.

19. Common areas and coliving life

Some residences include shared spaces and equipment. Their access is non-exclusive and must take place with respect for the other residents, the staff, the schedules and the internal rules.

Each resident undertakes to keep the common areas clean after their use, to respect the collective equipment and not to leave personal belongings hindering their use.

The permanent availability of each collective space or equipment cannot be guaranteed. WeStays Living may temporarily restrict access to them for reasons of safety, maintenance, repair, announced privatization or the proper functioning of the residence.

The community activities, meetings and events possibly offered constitute optional services. Their scheduling may be modified or cancelled without this necessarily affecting the validity of the stay.

20. Guests and visitors

The conditions of access for visitors may vary depending on the residence.

The resident must respect the maximum number of visitors, the schedules and the identification or registration procedures provided by the internal rules.

The resident remains responsible for the behavior of their guests as well as for the damage or nuisance they may cause.

Unless previously authorized, a visitor cannot spend the night in the residence or durably use the facilities as an additional resident.

21. Animals

Animals are prohibited.

When an animal is authorized, specific conditions, an additional deposit or cleaning fees may apply. The client remains responsible for any damage, nuisance or additional cleaning caused by the animal.

The rules relating to assistance animals remain subject to the applicable regulations.

22. Tobacco, alcohol and prohibited substances

It is prohibited to smoke or vape in the accommodations and in the common indoor areas, except in an expressly authorized zone.

The consumption of alcohol must remain reasonable and must not undermine the safety, tranquility or comfort of the other occupants.

The possession or use of substances prohibited by law is strictly forbidden.

Any intervention, cleaning or restoration made necessary by non-compliance with these rules may be charged to the client.

23. Equipment, internet and home automation

The residences may include connected equipment, Wi-Fi access, electronic locks, badges, access codes, applications or home automation installations.

The resident must use this equipment in accordance with the instructions provided. They are prohibited from transmitting their personal codes to an unauthorized person, from attempting to circumvent the safety devices or from interfering with the technical installations.

The access credentials must be protected. Any loss, disclosure or suspicious use must be reported immediately to WeStays Living.

Temporary interruptions may occur due to a breakdown, a maintenance operation, a network problem or an external event. WeStays Living strives to intervene within a reasonable time, taking into account the nature of the problem and the availability of the providers.

The Wi-Fi is intended for normal and lawful use. The resident remains responsible for the content viewed, downloaded, transmitted or shared from their devices.

24. Maintenance and access to the accommodation

The resident must promptly inform WeStays Living of any breakdown, leak, damage, anomaly or situation likely to affect the safety of persons or of the building.

The resident must not carry out or have carried out themselves any works or repairs without prior authorization, except in an absolute emergency intended to prevent imminent damage.

WeStays Living or its providers may access the accommodation to carry out maintenance, a repair, a safety inspection or a necessary intervention. Except in an emergency or in case of impossibility, the resident is informed beforehand within a reasonable time.

In an emergency situation, in particular in the event of a leak, fire, activation of an alarm or suspicion of danger, access may take place without prior agreement.

25. Damage, losses and additional fees

The client is responsible for the damage, losses and costs caused by themselves, their companions, their guests or their animals, with the exception of normal wear and tear or a defect not attributable to the resident.

The following may in particular be charged:

  • the repair or replacement of furniture and equipment;
  • the loss of keys, badges or access devices;
  • an exceptional cleaning;
  • a technical intervention made necessary by misuse;
  • the restoration after prohibited use;
  • the damage caused to the common areas;
  • the costs generated by an unjustified alarm or intervention;
  • the consumption or services not included in the price.

The client is informed of the fees claimed and may receive the available supporting documents.

26. Internal rules

Each residence may be subject to additional internal rules specifying in particular the quiet hours, the conditions of use of the common areas, the rules relating to visitors, safety, cleaning, waste and equipment.

The internal rules are sent or made accessible to the client before or at the start of the stay.

In the event of a contradiction, these conditions and the specific conditions prevail, except when a mandatory local rule or a safety rule imposes a different provision.

27. Breach by the resident and early termination of the stay

In the event of a breach of these conditions, of the specific conditions or of the internal rules, WeStays Living may request the resident to end the behavior concerned or to regularize the situation within a reasonable time.

In the event of a serious or repeated breach, WeStays Living may, subject to the applicable regulations, terminate the stay early, in particular in the event of:

  • non-payment;
  • a false declaration;
  • unauthorized exceeding of the accommodation's capacity;
  • subletting or assignment of the accommodation;
  • serious or repeated nuisances;
  • violent, threatening, discriminatory or dangerous behavior;
  • illicit activity;
  • significant damage;
  • endangering persons or the building;
  • refusal to comply with an essential safety instruction.

When the situation requires immediate intervention to protect persons or property, the stay may be terminated without prior notice.

The financial consequences are determined according to the circumstances, the sums already incurred, the services provided, the damage observed and the applicable mandatory rules.

28. WeStays Living's liability

WeStays Living undertakes to provide the confirmed services with diligence and in accordance with the essential characteristics communicated to the client.

In the event of difficulty during the stay, the resident must inform WeStays Living as soon as possible in order to allow an intervention or the search for a suitable solution.

WeStays Living cannot be held liable for damage resulting from:

  • a fault, negligence or non-compliant use by the resident;
  • non-compliance with the instructions or safety rules;
  • inaccurate or incomplete information provided by the client;
  • the act of a third party external to the performance of the contract;
  • a force majeure event;
  • an interruption attributable to a network operator or an independent supplier, subject to the obligations incumbent upon it.

The resident's personal belongings remain their responsibility. It is up to them to properly close the accesses and to take the reasonable precautions necessary.

No provision of these conditions limits or excludes a liability that could not legally be limited or excluded.

29. Third-party providers and services

Certain services may be provided by independent providers, in particular transport, additional cleaning services, activities, catering, parking, payment services or wellness services.

When the contract relating to a service is concluded directly between the client and the third-party provider, that provider's conditions apply.

WeStays Living is not responsible for the acts of an independent third-party provider when the service is not part of the contractual commitments made directly by WeStays Living, subject to the applicable mandatory provisions.

30. Force majeure and exceptional circumstances

No party can be held liable for a breach caused by an event reasonably beyond its control and preventing the normal performance of the contract.

Such circumstances may in particular include, depending on their nature and their consequences: natural disaster, fire, flood, armed conflict, act of terrorism, civil unrest, epidemic, general outage, major cyberattack, administrative closure, governmental restriction, evacuation order or serious interruption of essential transport or networks.

The party concerned informs the other party as soon as reasonably possible.

WeStays Living seeks, depending on the circumstances, a reasonable solution such as a modification, a rehousing, a postponement, a credit note or a refund of the services not performed. The solution depends on the nature of the event, availability and the costs already incurred.

31. Complaints

Any difficulty relating to the accommodation or the services must be reported during the stay as soon as it is observed in order to allow WeStays Living to intervene.

Any complaint after the stay must be sent in writing to:

It must specify the identity of the client, the booking references, the facts concerned and, where relevant, be accompanied by useful documents or photographs.

WeStays Living strives to acknowledge receipt and to respond within a reasonable time.

32. Personal data

The personal data collected in the context of requests, bookings and stays is processed in accordance with the WeStays Living Privacy Policy, accessible on the website.

This policy specifies in particular the purposes of the processing, their legal bases, their recipients, the retention periods, any international transfers as well as the rights of the persons concerned.

The rules relating to the trackers used on the website appear in the Cookie Policy.

33. Intellectual property

The website, its visual identity, its texts, photographs, videos, illustrations, logos, trademarks, graphic elements, databases and content are protected by the applicable intellectual property rights.

Unless authorized in writing in advance, it is prohibited to reproduce, modify, distribute, exploit or reuse all or part of these elements for commercial or public purposes.

The use of the website for strictly personal and informational purposes remains authorized in compliance with the law and these conditions.

34. Availability and use of the website

WeStays Living strives to keep the website accessible and up to date. However, it cannot guarantee permanent availability, the absence of errors or compatibility with all devices and browsers.

Access may be temporarily suspended for reasons of maintenance, security, updates or due to an event beyond WeStays Living's control.

The user undertakes not to harm the functioning of the website, attempt to access its systems without authorization, introduce malicious software or use the forms abusively.

35. Electronic communications and evidence

The client accepts that exchanges relating to their request or their booking may take place electronically, in particular by email, online form or messaging used by mutual agreement.

The confirmations, validations, electronic exchanges, transaction statements and payment receipts may be kept and used as evidence, subject to the applicable legal rules.

The client must ensure they provide accurate contact details and regularly consult the messages sent to them.

36. Modification of the general conditions

WeStays Living may modify these conditions to take into account the evolution of its services, its residences or the applicable regulations.

The version applicable to a booking is the one brought to the client's knowledge and accepted at the time of its confirmation.

A subsequent modification of the general conditions does not retroactively modify a booking already concluded, except by agreement of the parties or legal obligation.

The date of the last update appears at the top of this page.

37. Partial invalidity

If a provision of these conditions is declared null, invalid or unenforceable, the other provisions continue to produce their effects.

The provision concerned is, as far as possible, replaced or interpreted in a manner that preserves the objective pursued while complying with the applicable regulations.

38. Non-waiver

The fact that WeStays Living or the client does not immediately exercise a right provided by these conditions does not constitute a waiver of exercising it later.

39. Languages

These conditions may be offered in several languages.

In the event of a discrepancy between the versions, [the French version / the English version / the Hebrew version] prevails, subject to the mandatory rules applicable to the client.

The choice of the authoritative version must be clearly indicated before the confirmation of the booking.

40. Applicable law

These conditions are governed by [Israeli, to be confirmed] law, subject to any more protective mandatory provisions possibly applicable to the client due to their place of residence or the place of performance of the stay.

41. Amicable settlement and competent jurisdiction

In the event of difficulty, the client is invited to contact WeStays Living in order to seek an amicable solution.

Failing an amicable resolution, the dispute may be brought before the competent jurisdiction in accordance with the applicable legal rules.

No provision of these conditions deprives a consumer of the right to bring a matter before a jurisdiction open to them under a mandatory rule.
